Terms & Conditions

  1. The online store of Maciej Markiewicz’s Private Gallery, which can be found at www.galeria.maciejmarkiewicz.com, enables shopping via the internet and is the property of Maciej Markiewicz, email: maciej@maciejmarkiewicz.pl, NIP: 787-156-30-98.
  2. This document specifies the Terms & Conditions of sale by Maciej Markiewicz (hereinafter referred to as the Gallery) of works of art (hereinafter referred to as the works) online – via a webpage located at the address www.galeria.maciejmarkiewicz.com in the territory of Poland. Works can be shipped internationally, with a proviso that the payment method and costs of delivery will be arranged individually with the customer each time.
  3. All the works presented at www.galeria.maciejmarkiewicz.com are authentic pieces made by the author Maciej Markiewicz. The Gallery presents digital photos of the works. There may be slight differences between the photos and the originals; if the differences are more significant, it is indicated in the description of the photographed work.
  4. In principle, the artworks come without a frame.
  5. The prices quoted at www.galeria.maciejmarkiewicz.com are inclusive of VAT and are expressed in Polish zlotys (PLN). The prices do not include delivery charges. The price quoted for each product is binding once the customer places an order. The Gallery reserves the right to change prices, introduce new products, launch and terminate promotional campaigns.
  6. A proof of purchase is attached with each delivery.
  7. Standard deliveries in the territory of Poland are carried out by courier or Poczta Polska, according to the buyer’s preference. The delivery charges for the orders are covered by the buyer, according to the rates listed in the order form. The delivery method and cost for international shipments are arranged individually in each case.
  8. Orders can be placed with the Gallery using the order form available on the website. The moment the Gallery confirms the order placed by the Buyer, the contract is concluded. The purpose of the contract is to effect the sale of the artwork specified in the order. In order to carry out the transaction, the buyer must fill in the order form correctly, providing all the necessary data.
  9. Orders can be placed 24/7. Orders placed on Fridays after 2 p.m., on Saturdays, Sundays and holidays will be processed on the next business day.
  10. The order is released for processing once payment is credited to the Gallery’s bank account – in the case of payment by bank transfer, or once the order is confirmed – if the “cash on delivery” (COD) option was chosen.
  11. The following payment methods are available: cash on delivery – payment in cash upon collecting the order (the Gallery reserves the right to verify such orders additionally by phone), bank transfer – to the Gallery’s bank account, and online transfer (e-payment). Orders to be delivered outside the territory of Poland shall be paid for by transfer.
  12. If the payment remains outstanding after 5 business days since order confirmation, the order is cancelled automatically. It is tantamount to dissolving the contract between the Gallery and the customer. The buyer shall receive an email about the situation and the reason for order cancellation.
  13. The shipment shall be sent to the address indicated in the order form. With regard to the delivery times, please note that the estimated time for your order to arrive includes the processing time as well as the shipping time. In the case of payment by bank transfer, you should also include the payment processing time. Shipments are delivered by Poczta Polska usually within 2-5 days, and by courier – usually within 1-2 business days.
  14. Pursuant to the Act of 2 March 2000 on protecting certain consumer rights and on the liability for damage caused by a dangerous product, the customer may withdraw from the contract within 10 days of receiving the ordered goods (this provision applies to transactions where the buyer is a consumer, i.e. an individual making a purchase not related to their professional or business activity). The statement on withdrawing from the contract must be made in writing; it can be sent in electronic form to the address galeria@maciejmarkiewicz.pl. The customer shall return the received goods immediately, no later however than within 14 days of withdrawing from the contract. The goods returned in this manner will be accepted only if they are sent back in the same condition they were sent out, fully complete, free of damage or any signs of use other than for the purposes of checking the goods. Please enclose the proof of purchase with the return shipment. Within 3 business days of receiving the return, the Gallery shall verify it. If the goods meet the conditions specified hereinabove, the Gallery shall reimburse the buyer within 7 business days. The costs of return postage shall be the buyer’s liability. The Gallery shall not accept any COD return shipments. The right to withdraw from the contract does not apply to the artworks made by special request.
  15. All the artworks are authentic works of Maciej Markiewicz, and each one is the only copy. Complaints can only be submitted regarding products which got damaged or destroyed in shipment, or those which do not conform with the order.
  16. Complaints should be submitted by email to the Gallery’s address galeria@maciejmarkiewicz.pl. Please provide the order number, reason for the complaint and your full personal data. The Gallery shall not accept any COD return shipments. Within 14 calendar days of receiving the return, the Gallery shall respond to the complaint by email and notify the buyer regarding further steps. If the claim is successful, the Gallery shall reimburse the buyer for the full price of ordered works. The amount will be paid back within 7 days of settling the claim. Works can be exchanged for other artwork, and the difference in price shall be settled between the parties.
  17. When receiving the order shipment, the buyer should check its condition. If it is found that the packaging has been damaged or tampered with, a damage report should be written down in the presence of the shipper’s representative. The Gallery should be notified about this situation. Failure to note irregularities in the condition of the shipment at the time of delivery may negatively affect the buyer’s claim regarding incomplete or damaged shipment.
  18. Product photos on the website may slightly differ in colour from the originals; it depends on the positioning of your screen and the viewing angle. Slight colour differences between the internet presentation and the appearance of the original, and the differences described in the description of the work may not be treated as grounds for a complaint.
  19. If returning works on the grounds of withdrawing from the contract or a complaint, the Gallery shall immediately send an email providing the address to which the product is to be sent.
  20. Reimbursement on the grounds of withdrawing from the contract or a complaint – if the buyer had paid by bank transfer – is made to the bank account from which the payment had been made. In the case of cash on delivery shipments, or if the Gallery is unable to identify the account from which the payment had been made for reasons beyond their control, the reimbursement will be made to the account number provided by the customer. The account details can be provided to the Gallery via the contact form at www.galeria.maciejmarkiewicz.com. The Gallery reserves the right to verify the identity of the customer submitting the reimbursement request.
  21. It is not obligatory for the customers to provide their personal data, but refusal to do so makes it impossible to effect a purchase. By accepting these Terms & Conditions, the customer consents to having their personal data processed in compliance with the Personal Data Protection Act of 29 August 1997 for the purposes of order processing and separately for promotional and marketing purposes.
  22. All the textual content and visuals of artworks at Maciej Markiewicz’s Private Gallery registered under the domain www.galeria.maciejmarkiewicz.com are copyright protected. They may not be copied and distributed, used for commercial purposes or presentation on other websites without the author’s consent. The use of photographs and descriptions in full or in part without the author’s consent invariably constitutes a copyright infringement.
  23. The Gallery allows that photographs of works may be sold and the photographs from www.galeria.maciejmarkiewicz.com may be published. The terms and conditions for the use of photographs of works shall be subject to separate arrangements.
  24. These Terms & Conditions apply to purchases from the Gallery. By submitting and confirming an order you are consenting to all the provisions and information included hereinabove.
